Welcome to Erasa ("Erasa," "we," "us," or "our"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your") and Erasa governing your access to and use of Erasa's websites, mobile applications, desktop software, cloud-based tools, and all related online services (collectively, the "Services"). By accessing, browsing, registering for, or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (available at [Insert Privacy Policy URL]) and any additional terms or policies referenced herein. If you do not agree to these Terms, you must not access or use the Services.
1. Electronic Communications
By visiting Erasa’s websites, downloading our applications, or communicating with us via email, in-app messages, or other electronic means, you consent to receive electronic communications from Erasa. These communications may include notices about your account, updates to the Services, changes to these Terms or our Privacy Policy, promotional materials, and other information relevant to your use of the Services. You agree that all such electronic communications satisfy any legal requirement that communications be in writing, including but not limited to requirements under the Electronic Signatures in Global and National Commerce Act (ESIGN) in the United States or similar laws in other jurisdictions.
You may opt out of receiving promotional electronic communications by following the unsubscribe instructions included in those communications or by adjusting your account settings. However, you may not opt out of receiving non-promotional communications, such as those related to your account status, service updates, or legal notices.
2. Your Account
2.1 Account Registration
To access certain features of the Services, you may need to create an Erasa account. When registering for an account, you agree to provide accurate, current, and complete information about yourself ("Account Information") and to update your Account Information promptly if it changes. Falsifying or failing to update your Account Information may result in the suspension or termination of your account.
You must choose a secure password for your account and keep it confidential. You are solely responsible for maintaining the confidentiality of your account credentials (including your username, email address, and password) and for all activities that occur under your account, whether or not you authorized those activities. You agree to notify Erasa immediately [Insert Security Contact Email]if you suspect any unauthorized access to or use of your account, with specific contact through official channels as instructed by Erasa.
2.2 Account Restrictions
You may only maintain one Erasa account unless explicitly permitted by Erasa in writing. You may not transfer, sell, assign, or sublicense your account to any other person or entity. If you are using the Services on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" shall refer to such entity.
2.3 Age Requirements
You must be at least 13 years old to use the Services. If you are between 13 and the age of majority in your jurisdiction (typically 18 years old), you may only use the Services with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. If you are a parent or legal guardian consenting to a minor’s use of the Services, you are responsible for monitoring the minor’s use and ensuring compliance with these Terms.
2.4 Image Upload Requirements
Some Services allow you to upload images, including images containing your likeness or the likeness of others. By uploading any image, you represent, warrant, and covenant that:
• Voluntary Upload: The upload is voluntary and initiated by you, and you have the legal right to upload the image.
• Purpose Limitation: The image will be used solely for the purpose of detecting whether your content has been leaked, copied, reposted, edited, screenshotted, or otherwise misused online, in accordance with the functionality of the Services.
• Third-Party Consent: You have obtained explicit, written consent from any individual whose likeness appears in the image (other than yourself) before uploading the image. This consent must specifically authorize the upload and use of the image for the purposes described in these Terms.
• Prohibited Uploads: You will not upload images of public figures, celebrities, minors (unless you are the minor’s parent or legal guardian and have provided the required consent), or unrelated persons for the purpose of identification, verification, investigation, recognition, or similar purposes.
• No Biometric Identification: You will not use the Services to perform biometric identification or analysis of any individual, including but not limited to facial recognition for the purpose of identifying a person’s identity.
3. Links to Third-Party Sites / Third-Party Services
3.1 Linked Sites
The Services may contain links to external websites, applications, or services operated by third parties ("Linked Sites"). These Linked Sites are not owned, operated, or controlled by Erasa, and we have no control over their content, privacy policies, terms of use, or practices. Erasa provides these links solely for your convenience, and the inclusion of a link does not imply endorsement, approval, or responsibility for the Linked Site by Erasa.
You access Linked Sites at your own risk. Before using any Linked Site, you should review its terms of use and privacy policy to understand how your information may be collected, used, and disclosed. Erasa shall not be liable for any loss or damage arising from your use of any Linked Site.
3.2 Third-Party Service Providers
Certain functions of the Services, including but not limited to visual similarity processing for uploaded images, may utilize third-party service providers ("Processors") to assist in delivering the Services. Erasa only engages Processors that are subject to strict contractual confidentiality obligations and comply with applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR) for Processors operating within the European Economic Area (EEA).
By using the Services, you authorize Erasa to engage such Processors as needed to deliver the Services. Processors are only permitted to process your uploaded images to perform non-biometric similarity analysis required for content-protection purposes, and they are contractually obligated to:
• Not store your image after processing is completed (unless required by law);
• Not build any database, dataset, or collection from your uploads;
• Not use your content for analytics, training of machine learning models, or any purpose unrelated to the Services;
• Maintain the confidentiality and security of your content;
• Comply with all applicable data protection laws and regulations.
4. No Unlawful or Prohibited Use / Intellectual Property
4.1 Prohibited Uses
As a condition of using the Services, you agree not to use any Service—including image-based similarity analysis—in any way that violates applicable laws, regulations, or these Terms, or that infringes the rights of Erasa or any third party. Prohibited uses include, but are not limited to:
• Uploading images of others without their explicit, written consent;
• Attempting to identify any individual using the Services, including but not limited to matching images to public records or social media profiles to determine a person’s name, address, or other personal information;
• Using similarity results to harass, stalk, threaten, intimidate, blackmail, or "doxx" (publish personal information about) any individual;
• Uploading images of public figures, celebrities, minors, or unrelated individuals for the purpose of recognition, analysis, information gathering, or any other purpose not related to protecting your own content;
• Circumventing geographic restrictions, technical access controls, or security measures implemented by Erasa, including but not limited to using virtual private networks (VPNs) or proxy servers to access features restricted in your region;
• Using the Services in regions where image similarity processing is restricted or disallowed by applicable law;
• Modifying, reverse engineering, decompiling, disassembling, or attempting to derive the source code of any software or algorithms used in the Services;
• Using the Services to upload, transmit, or distribute any content that is harmful, abusive, defamatory, obscene, pornographic, violent, discriminatory, or otherwise unlawful;
• Using the Services for any commercial purpose without Erasa’s prior written consent, including but not limited to reselling access to the Services or using the Services to provide services to third parties;
• Interfering with or disrupting the Services, including but not limited to sending spam, viruses, or other malicious code, or engaging in any activity that imposes an unreasonable load on Erasa’s servers or networks;
• Misrepresenting the purpose or results of the Services, including but not limited to claiming that the Services can be used for biometric identification or that similarity results are definitive proof of infringement.
4.2 Intellectual Property Rights
All content and materials available through the Services, including but not limited to software, code, text, graphics, images, logos, trademarks, service marks, and data compilations, are owned by Erasa or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, display, perform, modify, adapt, create derivative works from, or exploit any of the Services or their content in any way without Erasa’s prior written permission.
Erasa’s name, logo, and other trademarks are the exclusive property of Erasa. You may not use Erasa’s trademarks without our prior written consent. All third-party trademarks referenced in the Services are the property of their respective owners.
5. Software – End User License Agreement (EULA)
By downloading, installing, or using any software provided by Erasa in connection with the Services ("Software"), you agree to the following end-user license terms ("EULA"):
• License Grant: Erasa grants you a non-exclusive, non-transferable, revocable license to use the Software solely for your personal or internal business purposes in accordance with these Terms and the Software's documentation.
• Restrictions: You may not reverse engineer, decompile, disassemble, modify, adapt, translate, or attempt to derive the source code of the Software; sublicense, rent, lease, loan, sell, assign, or transfer the Software to any third party; use the Software for any commercial purpose not authorized by Erasa; or use the Software in any way that violates applicable laws or these Terms.
• Ownership: The Software and all underlying code, processes, algorithms, and updates remain the exclusive property of Erasa. You acknowledge that you do not acquire any ownership rights in the Software by using it.
• Updates: Erasa may provide updates, patches, or modifications to the Software from time to time. These updates may be mandatory, and you agree to install them promptly to ensure the proper functioning and security of the Software.
• Termination: This EULA will terminate automatically if you violate any of its terms or these Terms. Upon termination, you must cease all use of the Software and delete or destroy all copies of the Software in your possession.
6. Materials Provided to Erasa
6.1 Ownership of Submissions
You retain all ownership rights to any content, images, or other materials you submit, upload, or transmit to Erasa through the Services ("Submissions"). Erasa does not claim ownership of your Submissions.
6.2 License to Submissions
By submitting Submissions to Erasa, you grant Erasa a limited, non-exclusive, non-transferable, revocable license to use, process, store, and transmit your Submissions solely for the purpose of providing the Services to you, including but not limited to:
• Processing your image for non-biometric similarity detection;
• Detecting copies, leaks, screenshots, impersonation attempts, or unauthorized distribution of your Submissions online;
• Generating and providing a match report to you;
• Facilitating optional removal or takedown actions for unauthorized copies of your Submissions;
• Complying with applicable laws and regulations.
6.3 Data Retention
Erasa is committed to protecting your privacy and minimizing the retention of your Submissions. Erasa does not:
• Store your uploaded images beyond the period necessary for processing (typically 24 to 48 hours) unless you explicitly choose to save a match report;
• Build permanent datasets or collections from your uploads;
• Retain extracted features (such as image hashes or similarity vectors) beyond the completion of your active request, unless required by law;
• Use your Submissions for training machine learning models, analytics, or any purpose unrelated to providing the Services to you.
All uploaded images and derived processing data are deleted automatically after the analysis is completed, unless you explicitly opt to save a match report. If you save a match report, the report (which may include thumbnail images of matches) will be stored in your account until you delete it or your account is terminated.
7. Third-Party Accounts
The Services may allow you to connect your Erasa account to third-party platforms, such as social media networks, cloud storage services, or email providers ("Third-Party Accounts"). By connecting your Erasa account to a Third-Party Account, you authorize Erasa to access and exchange information with that Third-Party Account in accordance with the third party's terms of service and privacy policy, as well as your privacy settings on that platform.
Erasa will only access the information necessary to provide the requested functionality, such as importing images from a cloud storage service or monitoring social media platforms for unauthorized copies of your content. You are responsible for managing your privacy settings on Third-Party Accounts and for ensuring that you have the right to authorize Erasa's access to the Third-Party Account. Erasa shall not be liable for any loss or damage arising from your use of Third-Party Accounts in connection with the Services.
8. International Users & Regional Restrictions
8.1 Global Availability
The Services are designed for global use, but their availability and functionality may vary by region due to local laws, regulations, and technical limitations. Erasa reserves the right to limit or restrict access to the Services in any region at any time, with or without notice.
8.2 Regional Restrictions on Image Processing
Certain features of the Services, particularly image-based similarity matching, may be limited, restricted, or disabled entirely in jurisdictions that regulate or prohibit such processing. These jurisdictions include, but are not limited to:
• Countries within the European Economic Area (EEA), due to restrictions under the GDPR on certain types of image processing;
• United Kingdom, in accordance with the UK GDPR;
• Belgium and Luxembourg, which have implemented strict regulations on facial recognition and image analysis;
• Specific U.S. states and municipalities, such as Illinois (Biometric Information Privacy Act, BIPA), Texas (Capture or Use of Biometric Identifier Act), and Washington (Biometric Information Privacy Law), which regulate the collection and use of biometric information;
• Regions with laws limiting non-biometric image or similarity analysis, including certain countries in Asia, Africa, and South America.
If a feature is restricted in your region, Erasa will automatically disable the relevant functionality. You agree not to circumvent such restrictions using VPNs, proxy servers, or other methods. Attempting to bypass regional restrictions may result in the suspension or termination of your account.
8.3 Compliance with Local Laws
You are responsible for ensuring that your use of the Services complies with all applicable laws and regulations in your jurisdiction, including but not limited to laws governing data protection, privacy, and intellectual property. Erasa makes no representations or warranties that the Services comply with the laws of any particular jurisdiction, and you use the Services at your own risk in this regard.
9. Indemnification
You agree to indemnify, defend, and hold harmless Erasa, its affiliates, subsidiaries, parent companies, employees, officers, directors, contractors, agents, and partners (collectively, the "Erasa Indemnitees") from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
• Your misuse of the Services, including but not limited to image-processing functions;
• Your uploads of unauthorized, infringing, or unlawful content;
• Your violation of any applicable law, regulation, or third-party right;
• Your breach of these Terms or any additional terms or policies referenced herein;
• Any harm caused to a third party by your use of the Services.
Erasa reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Erasa in the defense of such matter.
10. Liability Disclaimer
The Services, including all software, tools, features, content, and materials, are provided "as is" and "as available" without warranties of any kind, express or implied. Erasa expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Erasa does not guarantee:
• The accuracy, completeness, or reliability of similarity matches or other results generated by the Services;
• The detection of all leaks, unauthorized copies, or misuse of your content;
• The availability, functionality, or accessibility of any Linked Site or Third-Party Service;
• That the Services will be error-free, uninterrupted, or secure;
• That any defects or errors in the Services will be corrected.
Erasa shall not be liable for:
• Your interpretation or reliance on match results or other information provided by the Services;
• Any decisions or actions you take based on the Services, including but not limited to legal action against third parties;
• Missed or unintended matches, including but not limited to copies of your content that the Services fail to detect;
• Consequences of uploading content you do not have the right to upload, including but not limited to claims of infringement by third parties;
• Any loss or damage caused by third-party acts or omissions, including but not limited to Processors or Linked Sites;
• Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with the Services, even if Erasa has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of implied warranties or liability for certain types of damages, so the above exclusions and limitations may not apply to you. In such cases, Erasa's liability shall be limited to the maximum extent permitted by law.
11. Cancellation and Refund Policy
11.1 Subscription Cancellation
If you have a paid subscription to the Services, your subscription will remain active until you cancel it. You may cancel your subscription at any time by accessing your account settings and following the cancellation instructions. Cancellations will take effect at the end of the current billing period. You will continue to have access to the Services until the cancellation takes effect.
11.2 Refunds
No refunds or credits will be issued for partial billing periods, multiple accidental subscriptions, or unused service time, unless required by mandatory consumer protection laws in your jurisdiction (such as the Consumer Rights Directive in the EEA or similar laws in other regions). If you believe you are entitled to a refund under applicable law, please contact Erasa directly[Insert Support Contact Email] with your request and supporting documentation.
Erasa reserves the right to issue refunds at its sole discretion in cases of technical errors, service outages, or other exceptional circumstances.
12. Use of Communication Services
The Services may include communication features, such as in-app messaging, email support, or forums ("Communication Services"). You agree to use the Communication Services responsibly and in compliance with these Terms and applicable laws. You must not use the Communication Services to upload, transmit, or distribute any content that is harmful, abusive, defamatory, obscene, pornographic, violent, discriminatory, harassing, or otherwise unlawful.
Erasa reserves the right to monitor, review, restrict, or remove any content posted through the Communication Services at its discretion, without prior notice. Erasa may also suspend or terminate your access to the Communication Services if you violate these terms.
13. Termination / Access Restriction
Erasa may suspend or terminate your access to any part of the Services at any time, with or without notice, for any reason, including but not limited to:
• Your violation of these Terms or any additional terms or policies referenced herein;
• Misuse of the Services, including but not limited to image-upload or similarity-detection features;
• Violation of applicable laws or regulations;
• Inactivity of your account for a period of 12 months or more;
• Technical or security reasons;
• Discontinuation of the Services or any part thereof.
Upon termination, your right to use the Services will immediately cease. You must cease all use of the Services and delete any Software in your possession. Any provisions of these Terms that by their nature should survive termination (including but not limited to intellectual property rights, indemnification, liability disclaimers, and governing law) will continue to apply.
You may terminate your account at any time by contacting Erasa[Insert Support Contact Email] and requesting account termination. Upon account termination, all data associated with your account will be deleted in accordance with our data retention policy, except as required by law.
14. Changes to Terms
Erasa may update or modify these Terms from time to time to reflect changes in the Services, laws, or industry practices. When we make changes, we will update the "Last Updated" date at the top of these Terms and will notify you of the changes by email, in-app notification, or other electronic communication. The updated Terms will be effective immediately upon posting, unless we specify a later effective date.
Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must cease using the Services and terminate your account.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Erasa's operating entity is located, without regard to its conflict of laws principles. This choice of law applies regardless of your location or where you access the Services.
15.2 Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be submitted to Erasa's customer support team [Insert Support Contact Email]for informal resolution. If the dispute cannot be resolved informally within 30 days, the parties agree to resolve the dispute through binding arbitration administered by an arbitration institution agreed upon by both parties in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in the jurisdiction where Erasa's operating entity is located or at another location mutually agreed upon by the parties.
You and Erasa agree that any arbitration shall be conducted on an individual basis and not as a class, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Erasa. If any court or arbitrator determines that this class action waiver is invalid or unenforceable, then the arbitration agreement shall be null and void with respect to that dispute.
Notwithstanding the above, Erasa may seek injunctive relief or other equitable remedies in any court of competent jurisdiction to protect its intellectual property rights or to prevent harm to its business or users.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms or policies referenced herein, constitute the entire agreement between you and Erasa regarding your use of the Services, and supersede all prior or contemporaneous agreements, communications, and understandings, whether oral or written.
16.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The parties shall replace the invalid provision with a valid provision that achieves the original intent of the invalid provision.
16.3 Waiver
Erasa's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. A waiver of any provision shall only be effective if in writing and signed by Erasa.
16.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without Erasa's prior written consent. Erasa may assign or transfer these Terms at any time without your consent, including but not limited to in connection with a merger, acquisition, or sale of assets.
16.5 Notices

Notices sent via designated contact methods shall be deemed received upon confirmation of delivery.
